ŽIČARE KOTOR LOVĆEN 

The online shop https://shop.kotorcablecar.com/ (hereinafter the "Web shop") is managed by the company DRUŠTVO SA OGRANIČENOM ODGOVORNOŠĆU "ŽIČARA KOTOR - LOVĆEN" PODGORICA, TIN 03410021, with a registered address at Baku street no.140, Podgorica (hereinafter the "Company" or the "Service Provider").


 General Usage Terms of the Web shop (hereinafter the "Terms") prescribe the conditions and rules for end users (customer/passenger) (hereinafter "User"). By using the Web shop, the User admits that he agrees with the Terms and accepts to use the Web shop in accordance with the Terms. All prices on web shop are expressed in EUR (eur) and include VAT.


Any declination from these terms shall be considered valid only if they have been approved and confirmed in writing by the Kotor Cable Car, otherwise, these conditions apply to all visitors (may refer to User or users further on) without limitation.

Legal disputes that may arise as a result of the usage of the Web shop i.e. internet trade are under the jurisdiction of the competent court in Podgorica, and are resolved in accordance with the applicable legislation of the Montenegro. The User agrees that any dispute or request arising out of or in relation to the Terms is under the jurisdiction of the court in Montenegro. 


The User agrees and accepts that access to the Web shop may sometimes be interrupted, temporarily unavailable or disengaged due to routine maintenance of the website and also for other reasons for which the Service Provider is not responsible.


Kotor Cable Car reserves the right to, at any time and without prior notice, discontinue or modify any of the Terms stated here if deemed necessary, and such changes will take effect on the date of publication on the online store's pages. Continuing to use the online store or any part of its content or services after the publication of the new, modified Terms is understood as the User's acceptance of the changes.


Kotor Cable Car reserves the right to, at any time and without prior notice, alter, supplement, or discontinue any segment of web shop. This right includes, but is not limited to, changing the hours of availability, content, new data availability, modes of transmission, as well as rights to access or use the online store.


THE TERMS OF ACCEPTANCE

By purchasing the ticket via web shop, the User agrees to the application of this usage terms of web shop.


AMENDMENTS

All data and information published on the website are purely informative and considered accurate and reliable at the time of publication. 


Regarding this, Kotor Cable Car reserves the right to update existing information and add new information at any time. If deemed necessary at any time, and without prior notice Kotor Cable Car may amend any of the conditions stated here and such amendments will enter into force on the day of publication on the web shop page or official web page of Kotor Cable Car.


 These terms come into force from the date shown on the last page of this document and will remain in force with any amendments that can be made from time to time, until they are republished.

In addition to this, users are advised to re-read the information contained in the Terms from time to time, in order to be informed of any eventual amendments.


RESPONSIBILITY 

The User uses an online web shop solely at its own risk. The User is personally responsible for protecting the passwords confidentiality, at places where they exist as such. The User accepts that the Service Provider is not responsible for any data loss that may occur during the transmission of information on the Internet. 


In no event shall the Service Provider be responsible for any damage that may occur as a result of using of the web shop. For any possible damage, i.e. loss of data or damage to Users’ equipment, all responsibility rests with the User.


 The User will not hold the Service Provider responsible or make any claim for compensation for damages and costs that may arise from the use of the web store by the User.


COPYRIGHT  

Kotor Cable Car company owns all copyrights and other intellectual property rights to all content on this website. Unauthorized use of the website shall be considered misuse and infringement of copyright and related rights and is subject to sanctions in accordance with applicable laws.


Kotor Cable Car is not responsible for the content of external websites whose links may be found on any of the presentations on the website and are not owned by the Company.


USER TICKET CONFIRMATION

To use certain contents and services on the web shop, the User should provide his e-mail address to buy tickets via the web shop. By paying via debit or credit card, the details regarding the type of card, card number, authorization code, and validity period are not visible to Kotor Cable Car, nor are they collected, processed, or stored by Kotor Cable Car. Kotor Cable Car's website only redirects to the Internet Payment Gateway's website, where the payment process occurs. Kotor Cable Car does not process special categories of personal data.

 The entered email address will also be used to inform customers about promotions, offers, and additional information, and to send questionnaires about customers' experience with services, all in order to improve the quality of both the service itself and the web shop. By entering an email address when purchasing tickets, it will be considered that the User agrees with the sending of the aforementioned emails/notifications in order to improve user experience.


Your purchase through the web shop is voluntary, and providing your data is optional. If you enter your personal data in specific fields, it will be assumed that you consent to their processing.


REFUND POLICY

Once purchased, the tickets are non-refundable. However, in the event that the cable car is not operational due to technical issues or weather conditions, passengers will receive a full refund or the option to exchange their ticket for another date within the same operating season.


The cable car reserves the right to adjust operating hours for each season as necessary due to inclement weather conditions.


If unforeseen circumstances occur which according to the passenger opinion endangers him to use the ticket the option to exchange their ticket for another date within the same operating sea son. Kotor Cable Car management may consider the possibility of refunding the money, but this option is not guaranteed and will be evaluated on a case-by-case basis. It is important to note that requests for refund or exchange of a ticket must be submitted via official email as soon as such circumstance occurs.


Kotor Cable Car will appreciate the circumstances and respond to each such request within 14 days from the day of its receipt, whereby the Kotor Cable Car reserves the absolute right to reject the request for a refund without any special reasoning for such a decision.


Any request for a refund must be sent to customerservice@kotorcablecar.me along with any required supporting documentation as specified in these General Terms and Conditions of Carriage.


Additionally, the Kotor Cable Car management reserves the right to modify the refund policy at any time.


For the avoidance of doubt, lost tickets can not be replaced nor refunded.


TYPES AND METHODS OF PAYMENT 

Payment Security


Purchases in the online store are enabled through credit and debit bank cards such as MasterCard, Visa and Maestro. 


The Kotor Cable Car does not store, process, or transmit card data. The Kotor Cable Car allows users/customers to be redirected to the web pages of the IPG (Internet Payment Gateway) where the payment process is conducted.


 All elements of the payment platform are provided directly to the User by the Internet Payment Gateway, through the REDIRECT processor. The company does not have a card environment within its IT system, nor does it store, process, or transmit card numbers in any way.


In the case of a refund to a customer who previously paid with one of the payment cards, partial ly or in full, and regardless of the reason for the refund, this refund is made exclusively via the same VISA, Maestro or MasterCard card that was used for payment. This means that our bank will refund the funds to the card user's account at our request.


After the card details are entered and the payment is confirmed, the bank authorizes the transac tion, indicating that the order is approved and moves to the next stage of preparation for delivery. The amount will be reserved on your card (account) and will not be available for other purposes.


Please note that all payments will be effected in Euro (EUR). If the payment is done using for eign issuers payment cards, total amount of transaction will be converted into bank settlement currency, according to the current exchange rate of Visa, Mastercard or Maestro.


If necessary, the User is obliged to check with the bank that issued the card whether it supports online payments. 


The Kotor Cable Car do not sell or rent your personal information to third parties for their marketing purposes without first giving you the option to opt out. However, we may share your information with our business units and partners that are part of this Privacy Policy. Under no circumstances will we misuse your personal information.


Entry and transmission of personal data

Entry and transmission of personal data and credit card numbers are protected by the highest security standards provided by the All Secure system for online credit card authorization, in accordance with the requirements of card issuers and card brands, as well as the PCI DSS standards. Authorization and payment of credit cards are performed using the All Secure system for real-time card authorization and payment.


 When making a purchase through our online store, card payments are processed through the CKB bank channel and the All Secure system. During the payment process, the customer must enter their information, such as card type, card number, expiration date, and the security code on the back of the card.

QUESTIONS, OBJECTIONS AND COMPLAINTS

Any complaints should be submitted via email to: customerservice@kotorcablecar.me . A written response addressing the content of the complaint and proposing a resolution will be provided to User without delay and no later than eight days from receipt. In case the complaint cannot be resolved immediately, a written confirmation of receiving the complaint will be issued.
